Terms of sale for the Captivo software

This is a translation of the French terms of sale (conditions générales de vente), provided for information. In the event of any discrepancy, the French version prevails.

Version of 27 October 2026. These terms apply to any subscription to the Captivo software. They are written to be read: if a passage seems unclear to you, write to support and it will be reworded.

1. Purpose

These terms govern the provision, by La Cabine Bretonne, a single-shareholder simplified joint-stock company (société par actions simplifiée à associé unique) with a share capital of €1,000, whose registered office is at 3 rue du Docteur Aussant in Rennes (35700), registered with the Rennes Trade and Companies Register (RCS) under number 100 783 075 (hereinafter ‘the publisher’), of a right to use the Captivo software on a subscription basis, as well as of the associated online services: galleries, QR code sharing, web and mobile app.

Captivo is reserved for professionals acting in the course of their commercial, industrial, craft or liberal professional activity. By taking out a subscription, the customer declares that it is acting in that capacity.

2. Free trial

The trial lasts 30 days from the first time the software is opened. It gives access to the plan and to all add-ons, including the app. No means of payment is requested and no subscription starts automatically at the end of the trial.

When the trial expires, the software stops creating sessions and printing. Files produced during the trial remain on the customer’s disk and can still be viewed and exported.

3. Plan, add-ons and prices

The subscription comprises a plan and, at the customer’s choice, one or more add-ons. The content of the plan, the list of add-ons and their prices are set out on the pricing page, which forms an integral part of these terms. Unless otherwise stated on that page, an add-on applies to the customer’s entire account.

A ‘booth’ means a computer on which the software is activated. The plan authorises one booth; each additional booth is the subject of an add-on. An activation can be transferred freely from one computer to another from the customer area.

Add-ons can be added and removed at any time from the customer area. The addition of an add-on is invoiced pro rata to the days remaining in the current period. Removal takes effect at the end of the period already paid for, with no refund for the period already begun.

Prices are stated in euros excluding VAT. VAT at the rate in force is added for customers established in France. Professional customers from another Member State of the European Union holding a valid intra-Community VAT number are invoiced excluding VAT, under the reverse-charge mechanism.

4. Duration, renewal and termination

The subscription is taken out for one month or for one year, as chosen by the customer. It is tacitly renewed for an identical period.

For an annual subscription, the customer is informed by email at least 15 days before each expiry date.

Termination is carried out from the customer area, without any reason having to be given and without formalities. It takes effect at the end of the current period, which has already been paid for. No pro rata refund is due for the period already begun, except in the cases provided for in articles 10 and 11. Article 8 also provides for a credit note in the event of prolonged unavailability of the online services.

A monthly subscription may be interrupted and then resumed at any time. An annual subscription cannot be suspended mid-period: this is the trade-off for the reduced rate.

5. End of subscription and what happens to data

At the end of the subscription, the software reverts to read-only mode: the customer retains access to its sessions, photos, templates and settings saved locally, but can no longer create a session or print.

Published online galleries remain accessible for 60 days after the end of the subscription, and are then deleted from the servers and backups. It is the customer’s responsibility to export them before that date. The publisher sends a reminder 15 days before deletion.

6. Customer’s obligations

The customer assumes responsibility for the compliance of its business, in particular for obtaining the authorisations required for taking and distributing images of the people photographed. The publisher provides no legal advice on this point and does not intervene in the relationship between the customer and its own clients or their guests.

The customer undertakes not to use the software to produce or distribute unlawful content.

7. Support and scope

Support covers the operation of the Captivo software and the associated online services. It does not cover the customer’s hardware, third-party manufacturers’ drivers, the operating system, antivirus software or the network connection. This scope is detailed on the support page (in French).

The response time stated on the contact page is a target and not a commitment: exceeding it gives no entitlement to any penalty. Support is provided in writing, in French, English or Spanish.

8. Availability of the online services

The publisher uses reasonable endeavours to ensure the availability of the galleries and of QR code sharing. No quantified service level is guaranteed.

In the event of continuous unavailability of the online services exceeding 72 hours and attributable to the publisher, the customer may request a credit note pro rata to the duration of the unavailability. Capture and printing, which work offline, are not covered.

9. Liability

The publisher’s liability, all causes combined, is limited to the sums actually paid by the customer in respect of the twelve months preceding the event giving rise to liability.

The publisher shall not be held liable for indirect damage, in particular loss of turnover, loss of clientele or damage to reputation resulting from a failure occurring during an engagement.

It is the customer’s responsibility to test its complete setup before any engagement and to plan a fallback solution. The download page describes a complete test session.

10. Cessation of the publisher’s business

Captivo is published by a very small organisation. In the event of permanent cessation of the publishing business, the publisher undertakes to publish, within 90 days, a version of the software whose activation no longer depends on a subscription, allowing capture and printing to continue offline.

Customers with a current subscription are notified at least 60 days in advance and retain the ability to export all of their galleries during that period. Sums corresponding to the unperformed period are refunded pro rata.

11. Changes to the terms

Any substantial change to these terms or to the prices is notified to the customer at least 30 days before it comes into force. The customer has that period in which to terminate free of charge, with a pro rata refund if it is on an annual subscription.

12. Personal data

The processing of personal data is described in the privacy policy (in French), which forms an integral part of these terms.

13. Governing law and disputes

These terms are governed by French law. As Captivo is sold to professionals, consumer mediation (médiation de la consommation) does not apply. The parties undertake to seek an amicable solution before any action; failing that, the French courts alone have jurisdiction.
